Important Terms and Conditions of Rental

 

 

TO RENT A UNIT EVERY RENTER MUST AGREE TO THESE TERMS AND CONDITIONS

LATE PAYMENT AND CHARGES: If rent is not paid within ten (10) days of each due date, a $10.00 Late Charge will be added. If Amount Due remains unpaid on the 30th day past due, an additional $10.00 Late Charge shall be added each month the account remains past due. Overlock will be added to any unit when the account is more than 10 days past due until all charges are paid in full, or if the Tenant does not maintain a valid mailing address on file. Tenant is responsible for late charges, cost of collection, collection contingency fees, legal notices, attorney, liens, disposal, remediation, repairs, and cleaning.

PAYMENT: All payments made shall be applied first to the oldest charges due at the time of payment. Tenant agrees to pay promptly for any repairs of the premises caused by Tenant's negligence, misuse, or abuse. Owner may refuse any form of payment. Partial payment of amount due will not stop late charges, lien sale or proceedings against Tenant.

SECURITY DEPOSIT: Security Deposit (if required by Owner) shall be held and commingled with any funds by Owner. Should Tenant leave any amount unpaid when vacating unit, some or all of Security Deposit shall be used to satisfy any amount due, including charges for damage repair or cleaning, and any remaining amount shall be refunded within a reasonable period of time. No interest shall be paid to Tenant on the Security Deposit.

NO BAILMENT: THE OWNER IS NOT A WAREHOUSEMAN ENGAGED IN THE BUSINESS OF STORING GOODS FOR HIRE, AND NO BAILMENT IS CREATED BY THIS AGREEMENT. THE OWNER EXERCISES NEITHER CARE, CUSTODY, NOR CONTROL OVER TENANT'S STORED PROPERTY. ALL PROPERTY STORED WITHIN THE SPACE OR ON THE PROPERTY OR LOCATED AT THE FACILITY BY ANYONE SHALL BE STORED AT THE TENANT'S SOLE RISK.

LIABILITY: Tenant shall hold Owner harmless from any and all claims or cause of action arising out of Tenant's use of the premises including any guest of Tenant. Tenant shall not cause or allow any damage to the premises and shall be liable for reasonable cost of cleaning or repairs to return premises to its' original condition. Tenant agrees to release Owner from any and all liability for any loss or damage to Tenant's personal property regardless of cause or negligence, including acts of god, theft, fire, water, pests, mold, mildew, flood, or any other peril.

INSURANCE: Tenant acknowledges that Owner does not provide any insurance to cover any loss of stored property that Tenant may have or claim by use of the facility. Tenant shall maintain, at Tenant's expense, an insurance policy to cover stored goods from loss for the actual cash value of all stored property. If Tenant does not maintain insurance then Tenant will be deemed to be "self insured" and assumes all risk for any loss incurred.

LIMITATION OF VALUE: Tenant agrees that in no event shall the total value of all stored property be deemed to exceed $5000, even if the actual value of the property is greater than the stated limit.

COMPLIANCE WITH THE LAW: The storage unit or premises will not be used for any unlawful purpose.

USE AND CONDITION: STORAGE UNIT SHALL NEVER BE USED TO STORE FOOD, OR OVERNIGHT SLEEPING, HABITATION, OR REPAIR WORK. NO SMOKING, COOKING, OR OPEN FLAME. Tenant will not store any explosive, flammable, hazardous, corrosive, toxic, poisonous, illegal property, asbestos, batteries, e-bikes, oil, construction waste, or any item in conflict with any law or regulation, or more than 4 tires without express written consent of Owner. Charge of $400 for violation of this paragraph. Except for existing lights, no use of electricity is allowed except by express, written consent of Owner. Tenant may not use Owner's garbage collection area for disposal of any item. Tenant is responsible for all costs of removal and disposal of any items abandoned or left outside of unit. Tenant accepts condition of premises "as is" and agrees to make no alterations. Owner retains the right to inspect the premises at any time with reasonable notice. Tenant understands the area is NOT climate controlled (unless otherwise stated in writing) and the Tenant is solely responsible for monitoring and protecting Tenant's goods. Tenant agrees that the space is not appropriate for the storage of live or dead animals, jewelry, furs, heirlooms, art works, collectibles, or other irreplaceable items having special sentimental or emotional value and agrees not to store such items. Tenant agrees that stated measurement of unit size is approximate. Owner makes no guarantee of size or fitness for any particular use. Tenant shall store nothing that attracts pests and understands that pest control is the responsibility of the Tenant since Owner has no access to the unit. Tenant is allowed ONE lock per unit. Tenant shall never cut the lock off any unit and if a Tenant needs a lock cut, Tenant agrees to pay Owner $10.00 to remove the lock.

FEES: Set-up Fee: $8.00 per new leased unit. Security Deposit: $40.00 or more per unit depending on the monthly rate of the unit. Transfer Fee: $8.00 per Lease to change/reassign a name or unit to unit transfer. Cleaning Fee: $15.00 minimum charge, $40.00 per man-hour plus materials & supplies. Hauling Fee: $20.00 or more to clear or haul abandoned goods from a unit. Disposal Fee: $20.00 or more for disposal of items left on premises. Repairs: $40.00 per hour or actual cost, whichever is greater. Lock Removal: $10.00 minimum to cut or otherwise remove customer's lock. Latch Replacement: $15.00 minimum to replace latch damaged by customer. Certified Mail Fee: $15.00 for mailing a Certified Mailing with the Postal Service. Legal Notice Publication Fee: $25.00 minimum or actual cost for legal notice in the newspaper. Returned Check Fee: $20.00 minimum for any check or payment returned for any reason.

EXPIRATION AND RENEWAL: Lease expires on the last day of each monthly term. Tenant's failure to vacate the premises and remove their lock automatically renews the lease for the next month. All covenants and conditions contained herein shall continue in full force so long as Tenant retains possession of premises.

NOTICE OF LIEN: In accordance with the Illinois Self-Service Storage Facility Act (770 ILCS 95): Owner is hereby given a lien upon all stored property. Should Tenant's account remain unpaid for 30 days, Owner may enforce said lien which may include sale or other disposition of the property in order to satisfy said lien. If the property stored is a vehicle or watercraft, the Owner may have the property towed from the facility and/or sold.

BREACH: A breach of any of the foregoing covenants and conditions by Tenant shall, at the option of Owner, terminate this lease and all monies owed for rent and fees shall become immediately payable.

NOTICE: Tenant shall advise Owner of any address or contact information change within 5 days of such change in writing to Owner's address. Owner shall send notices to last known address of Tenant. Tenant authorizes Owner to send collection, lien, or other notice, via paper or electronic method, at any time of day to any contact Tenant gives to Owner.

ASSIGNMENT: Tenant shall not sublet or assign all or any portion of the premises or Tenant's interest therein without the written consent of Owner. If approved, any reassignment requires a new Lease Agreement. CHANGES: Rental rate, charges, fees, facility hours, terms of use, rules and policies may be changed at any time by Owner by providing 10 days notice in writing to Tenant by mail, posted notice, or posted sign on the premises. A new Lease is not required to be executed for any posted change to be in full force and effect.

UNUSED RENT: Tenant agrees to a 30 day minimum rental period. After the minimum, any money from unused rent, less cleaning & damage repairs, shall be refunded within a reasonable period of time.

TERMINATION: This agreement may be immediately terminated by either party with written notice. Should Owner find Tenant's unit unlocked and account unpaid, Owner will consider the Lease terminated and shall take possession of said unit. Should Tenant abandon or leave behind any property after termination, Owner shall consider the goods abandoned and dispose of said property at Tenant's expense. Tenant should return possession of premises in broom-clean, empty, good condition, subject only to normal wear and tear, and ready to re-rent. When vacating unit, Tenant shall immediately satisfy any Balance Due and pay to repair any damages or cleaning cost. Any unpaid balance will remain the responsibility of Tenant and shall accumulate Late Charges and costs of collection until the balance is paid in full.

Also Very Important

* Do not store food or any item that could attract pests.

* Do not put mattresses or cardboard boxes directly on concrete floors.

* Do not store anything that could be damaged by freezing or split open.

* Do not store hazardous, flammable, combustible, or regulated products, including paint, paint thinners, gasoline, diesel, kerosene, or propane in a storage unit.

* Open the unit every month or so to inspect and air out, especially in hot, humid weather.

* We strongly recommend you use a humidity control product like Damp-Rid™ during humid weather to reduce humidity in your storage unit.

Good Locks Are Important!
Purchase a good quality, heavy duty keyed lock. Your stored goods are worth it! Do not use light weight, combination or gun locks. Look for a lock with a Hardened Steel Shackle no larger than 3/8-inch. A Chateau C870 or C970 are excellent locks as they are designed specifically for self storage use. We sell Chateau locks at an excellent price. You are free to provide your own lock if you have one.

 

 

YOUR SUCCESS IN STORING IS COMPLETELY DEPENDENT UPON YOU MONITORING AND PROTECTING YOUR GOODS. WE RECOMMEND OPENING YOUR UNIT ON A MONTHLY BASIS TO CHECK YOUR STORED GOODS. SINCE WE DO NOT KEEP A KEY TO YOUR STORAGE UNIT, WE CAN NOT MONITOR IT FOR YOU.
